Welcome to 123JUMP. In these general terms and conditions, you can read which agreements apply when you book a swimming course, swimming vacation, or related service with us. We have drawn up these conditions as clearly as possible so that you know where you stand in advance.

Application of these conditions
These general terms and conditions apply to all registrations, bookings, agreements, and services provided by 123JUMP, unless otherwise agreed upon in writing.
If any provision within these terms is found to be invalid, the remaining provisions will continue to be in full force and effect.

Registration and agreement
Registration is carried out through our website, registration form, or another method accepted by 123JUMP.
An agreement is established once we confirm the registration by email or once we begin the performance of the booked service.
We generally process registrations in the order they are received. In some cases, we may deviate from this to ensure groups are well-organized based on age, level, or safety.

Participation in lessons
For participation in an A-diploma course, a minimum age of 4.5 years at the start of the course generally applies, unless 123JUMP decides otherwise.
For participation in a B-diploma course, the child is generally required to already have an A-diploma.
For participation in a C-diploma course, the child is generally required to already have a B-diploma.
123JUMP may set additional conditions if necessary for safety, lesson quality, or proper group placement.

Swimming level, progress, and exams
123JUMP guides children in their development toward the level required for a diploma exam.
Participation in a course does not automatically guarantee that a child will be eligible for the exam or will receive a diploma. We assess eligibility based on level, progress, independence, technique, and safety in the water.
Any additional costs for exams or diploma issuance will be communicated clearly in advance.

Medical information and safety
The safety of children is always central at 123JUMP.
It is important that parents or guardians provide all relevant information upon registration for a safe and responsible participation. This includes:
- allergies
- use of medication
- medical particulars
- physical or mental limitations
- fear of water
- behavior or attention points that may influence the lesson
If the child's situation changes after registration, please inform us as soon as possible.

Planning, lesson times, and locations
We do our utmost to conduct lessons, times, locations, and instructors as announced.
However, changes may sometimes be necessary due to organizational circumstances, pool availability, group indexing, or unforeseen situations.
123JUMP reserves the right to make reasonable changes in planning, lesson times, days, locations, group composition, and instructors. If changes occur, we will inform parents or guardians as quickly as possible.

Cancellations and force majeure
Sometimes lessons or activities cannot proceed due to circumstances beyond our control (instructor illness, pool issues, force majeure, extreme weather, etc.).
In such cases, 123JUMP may reschedule, suspend, or offer a reasonable alternative. We always strive to find a suitable solution. Refunds are only considered if the service is permanently impossible and no alternative is available.

Behavior and house rules
House rules and safety regulations apply in and around the swimming facilities. Parents, guardians, and children must respect these rules and follow the instructions of our instructors and staff.
If a child or guardian's behavior seriously disrupts safety, peace, or progress, 123JUMP may decide to temporarily or permanently terminate participation.

Prices and payment
All communicated prices are in Euros and include VAT unless explicitly stated otherwise. Payment must be made according to the conditions and deadlines stated during registration, confirmation, or on the invoice.

Cancellation by parent or guardian
Cancellations must be made in writing or by email. Unless agreed otherwise, the following applies:
- More than 4 months before start: refund minus 15% administration fee.
- Between 4 months and 2 months: 50% refund.
- Within 2 months: no refund.
If your child cannot participate, their spot may in some cases be taken by another child, provided 123JUMP agrees in writing.

Cancellation by 123JUMP
123JUMP may cancel a course due to insufficient participants, if performance is reasonably impossible, or due to force majeure. We will inform you as soon as possible and refund the amount for the part that does not take place if no alternative is possible.

Liability
123JUMP is only liable for direct damage that is the direct result of an attributable error. We are not liable for indirect or consequential damages. Liability is limited to the amount paid out by our insurance.

Third-party services
When accommodation, transport, or other supplementary services are offered by third parties, 123JUMP is only responsible for them if explicitly agreed upon in writing.

Do you have a complaint? Please contact us at contact{'@'}123jump.nl. We aim to respond substantively within a reasonable period.

Applicable law
All agreements with 123JUMP are governed exclusively by Dutch law. Disputes will be submitted to the competent court in the Netherlands.

Conclusion
These general terms and conditions are made available before or at the time of the agreement. For situations not explicitly covered here, we look for a reasonable solution in line with the law.
